1. About These Terms

These Terms and Conditions (“Terms”) apply to your use of the You Are What You Eat mobile application (“App”) and to orders placed through the App. By creating an account, using the App or placing an order, you agree to these Terms. If you do not agree to these Terms, please do not use the App or place an order. These Terms should be read together with our Privacy Policy, which explains how we collect and use personal information.

3. Using the App

You may use the App to:
  • Browse available food and menu items
  • Create and manage an account
  • Place food orders
  • Select delivery options
  • Select available payment methods
  • Track the status of your order
  • Manage information associated with your account
You are responsible for ensuring that the information you provide is accurate and up to date. You must not:
  • Use the App for unlawful purposes
  • Attempt to gain unauthorised access to the App or its systems
  • Interfere with the operation or security of the App
  • Submit false or misleading information
  • Use another person’s account without permission
  • Attempt to place fraudulent or unauthorised orders

4. Eligibility

You must be legally capable of entering into a contract to place an order. If you are under the age required to enter into a contract under applicable law, you should only use the App with the involvement and permission of a parent or guardian.

5. Menu Items and Availability

We make reasonable efforts to ensure that menu descriptions, prices and images displayed in the App are accurate. However:
  • Menu items may change from time to time.
  • Ingredients and availability may change.
  • Images are for illustration and presentation purposes.
  • An item may become unavailable after you have placed an order.
  • We may make reasonable substitutions or changes only where permitted and appropriate, and where necessary we will contact you.
If an item becomes unavailable and we cannot fulfil it, we will contact you where reasonably possible and arrange an appropriate refund or alternative.

6. Prices

All prices displayed in the App will be shown in pounds sterling (£). The price payable for your order will be the price displayed at checkout, together with any applicable delivery charge and other charges clearly shown before you place the order. We reserve the right to correct genuine pricing errors. If a pricing error affects an order you have placed, we will contact you where reasonably possible before fulfilling the order. You will not be required to pay an incorrect price where the error is identified and the correct price is materially different.

7. Placing an Order

Before placing your order, you should carefully check:
  • The items in your basket
  • Quantities
  • Portion selections
  • Order notes
  • Delivery address
  • Postcode
  • Delivery charges
  • Payment method
  • Total price
The App provides an opportunity to review and correct your order before placing it. When you select the button to place and pay for your order, you are requesting that we accept the order and agree to pay the amount shown. Your order is not guaranteed to be accepted simply because it has been submitted.

8. Order Acceptance

When you place an order, we will provide confirmation that we have received it. An order becomes accepted when we confirm that we are able to fulfil it. We may refuse or cancel an order where, for example:
  • An item is unavailable
  • The delivery address is outside our delivery area
  • The App contains a genuine pricing or technical error
  • We are unable to fulfil the order
  • Payment has not been successfully authorised
  • We reasonably suspect fraudulent or unauthorised activity
  • Ordering has been temporarily closed
If we cancel an order after payment has been taken, we will arrange an appropriate refund.

9. Delivery

We deliver to eligible areas based on the postcode provided during checkout. Delivery charges may vary depending on the delivery zone and will be displayed before you place your order. Estimated delivery times shown in the App are estimates and are not guaranteed unless expressly stated otherwise. Delivery may take longer because of circumstances including:
  • High demand
  • Traffic
  • Weather
  • Road closures
  • Vehicle problems
  • Unexpected operational issues
  • Other circumstances outside our reasonable control
We will make reasonable efforts to keep you informed if there is a significant delay.

10. Your Delivery Address

You are responsible for providing a correct and complete delivery address and postcode. If you provide an incorrect address and the order cannot be delivered as a result, this may affect your ability to receive a refund. You should ensure that someone is available to receive the order where appropriate. You should also provide any relevant delivery instructions through the App.

11. Delivery Instructions and Order Notes

You may provide order notes or delivery instructions during checkout. Order notes may be passed to the kitchen or relevant staff to assist with preparing your order. Delivery instructions may be provided to the person delivering your order. We will make reasonable efforts to follow reasonable instructions, but cannot guarantee that every instruction can be followed. You must not use order notes or delivery instructions to provide abusive, threatening, illegal or inappropriate content.

12. Payment

We currently support the payment methods displayed in the App. Card payments are processed using Stripe. We do not store your complete payment card details ourselves. For card orders, payment may be authorised or taken when you place the order. For cash orders, payment is due in accordance with the payment option shown during checkout. If payment fails or is not authorised, we may be unable to accept or fulfil your order.

13. Cancellation of Food Orders

Because food is prepared specifically for an order and may be perishable, the normal statutory cancellation rights that apply to many online purchases may not apply in the same way to food orders once preparation has begun. If you wish to cancel an order, contact us as soon as possible at: info@youarewhatyoueat.uk We will consider cancellation requests where the order has not yet been prepared or where cancellation is otherwise reasonably possible. Once preparation has begun, cancellation may no longer be possible. Nothing in these Terms affects any cancellation or refund rights you have under applicable consumer law.

14. Refunds

If an order cannot be fulfilled by us, we will arrange an appropriate refund for any amount you have paid for the affected order. If there is a problem with your order, please contact us as soon as reasonably possible at: info@youarewhatyoueat.uk Depending on the circumstances, we may provide:
  • A replacement
  • A partial refund
  • A full refund
  • Another appropriate remedy
Your statutory consumer rights are not affected by these Terms.

15. Incorrect, Missing or Damaged Items

If your order is incorrect, incomplete or arrives in an unacceptable condition, please contact us as soon as possible. Please provide:
  • Your order number
  • A description of the problem
  • Any relevant information or photographs where appropriate
We will investigate the issue and provide an appropriate remedy in accordance with applicable law.

16. Food Allergies and Dietary Requirements

We take food allergies and dietary requirements seriously. However, our food may be prepared in an environment where allergens are present. Ingredients and preparation methods can change. If you have a food allergy or serious dietary requirement, please contact us before placing an order if you need specific information about ingredients, allergens or preparation. Do not rely solely on an order note for serious allergy information. We will provide allergen information where required by applicable food safety law.

17. Food Quality and Consumer Rights

We will provide food that complies with applicable consumer and food safety requirements. Nothing in these Terms limits or excludes your statutory rights. Where applicable, goods must be of satisfactory quality, fit for purpose and as described. We will not attempt to exclude liability that cannot legally be excluded.

18. Account Security

If you create an account, you are responsible for keeping your account information secure. You should notify us if you believe that your account has been accessed without your permission. We may suspend or restrict an account where we reasonably believe that it has been compromised or used fraudulently.

19. Account Deletion

You may delete your account through the account deletion functionality available in the App. Deleting your account does not necessarily delete information that we are legally required or otherwise permitted to retain, including certain transaction and accounting records. Further information is provided in our Privacy Policy.

20. App Availability

We aim to keep the App available and functioning properly, but we cannot guarantee that it will always be:
  • Available
  • Error-free
  • Uninterrupted
  • Free from technical problems
The App may occasionally be unavailable because of maintenance, updates, technical problems or circumstances outside our reasonable control.

21. Intellectual Property

The App and its content, including where applicable:
  • Branding
  • Logos
  • Text
  • Graphics
  • Images
  • Software
  • Design
are owned by or licensed to You Are What You Eat or the relevant rights holder. You may use the App for its intended personal and lawful purpose. You must not copy, reproduce, modify, distribute or commercially exploit our content without appropriate permission.

22. Third-Party Services

The App may use third-party services including payment and technology providers. These services may be subject to their own terms and policies. For example, payments are processed through Stripe. We are not responsible for matters relating to third-party services that are outside our reasonable control, although this does not affect your statutory rights or our responsibilities for services we provide.

23. Privacy

Our Privacy Policy explains how we collect, use and protect your personal information. You can access the Privacy Policy through the App or our website.

24. Our Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful. In particular, nothing in these Terms excludes or limits liability for:
  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Breach of your statutory consumer rights
  • Any other liability that cannot legally be excluded or limited
Subject to the above, we are not responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control.

25. Events Outside Our Control

We will not be responsible for failure or delay in providing our services where this results from circumstances outside our reasonable control. These circumstances may include:
  • Severe weather
  • Flooding
  • Fire
  • Road closures
  • Traffic disruption
  • Power outages
  • Telecommunications failures
  • Major technical failures
  • Industrial action
  • Government action
  • Other events beyond our reasonable control
Where reasonably possible, we will take steps to minimise the effect of such circumstances on customers.

26. Suspension or Termination

We may suspend or restrict access to the App where reasonably necessary, including where:
  • The App requires maintenance
  • There is a security issue
  • Fraudulent activity is suspected
  • The App is being misused
  • Continued access would create a security or legal risk
Where appropriate, we will take reasonable steps to notify affected users. Nothing in this section affects rights you have under applicable law.

27. Changes to These Terms

We may update these Terms from time to time. Changes may be made where:
  • Our services change
  • New features are introduced
  • Our payment or delivery arrangements change
  • Legal or regulatory requirements change
  • We make improvements to the App
The latest version will be made available through the App or our website. Where a change materially affects your rights or obligations, we will take reasonable steps to notify you.

29. Governing Law

These Terms are governed by the laws of England and Wales. If you are a consumer, nothing in these Terms prevents you from relying on mandatory consumer protections that apply to you under the law.
